1. Acceptance of these terms

These Terms & Conditions govern your access to and use of buildautomategrow.com (the "Site"), operated by Build Automate Grow, LLC ("BAG," "we," "us"), a Wyoming limited liability company of Wheatland, Wyoming. By using the Site you agree to these terms. If you do not agree, please do not use the Site.

2. What this Site is — and isn't

The Site exists to describe our services and show past work. Its content is provided for general information only. Nothing on the Site:

• constitutes an offer, quote, estimate, or binding commitment
• creates a client relationship, or any duty of care, between you and us
• is professional, legal, financial, or technical advice for your situation
• guarantees any particular outcome, ranking, revenue, or performance result

3. Client engagements are governed separately

Any services we perform — development, automation, marketing, hosting, maintenance, or otherwise — are governed by a separate written agreement, proposal, statement of work, or service agreement signed or accepted by both parties. Where that agreement conflicts with these terms, that agreement controls for the subject matter it covers.

4. Intellectual property

Unless noted otherwise, the Site and its contents — text, layout, design, code, graphics, and the Build Automate Grow name, wordmark, and logo — are owned by us or used with permission, and are protected by copyright, trademark, and other laws.

You may view the Site, and print or download extracts for your own non-commercial reference. You may not otherwise copy, reproduce, republish, sell, or exploit any part of the Site, or use it to train machine-learning systems, without our prior written permission.

5. Client work, trademarks, and portfolio images

Our portfolio shows projects we have worked on over the years. Client names, logos, trademarks, screenshots, and other brand elements shown on the Site remain the property of their respective owners and appear for identification and reference only. Their appearance does not imply any current endorsement, partnership, or sponsorship.

Portfolio entries describe our involvement at the time of the project. Many of the sites shown have since been redesigned, transferred, or are maintained by others; we badge entries to indicate this where we can, but we make no representation about the current state, ownership, content, or performance of any third-party site. If you own a project shown here and would like it removed, contact us and we will do so promptly.

6. Acceptable use

You agree not to:

• use the Site unlawfully, or in a way that could damage, disable, or impair it
• attempt to gain unauthorized access to the Site, its server, or any connected system
• probe, scan, or test the vulnerability of the Site without our written authorization
• use automated means to scrape or harvest the Site beyond ordinary search-engine indexing
• introduce malware or any other harmful code

7. Third-party links

The Site links to third-party websites, including former client projects. Those sites are not under our control. We provide the links for convenience and reference, and their inclusion is not an endorsement. We are not responsible for their content, accuracy, availability, or practices, and visiting them is at your own risk.

8. Availability and changes

We may change, suspend, or discontinue any part of the Site at any time without notice. We do not warrant that the Site will be uninterrupted or error-free. We may also revise these terms; the revised version takes effect when posted, and the "Last updated" date will change. Continued use after a change constitutes acceptance.

9. Disclaimer of warranties

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BUILD AUTOMATE GROW, LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, BUSINESS, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF — OR INABILITY TO USE — THE SITE, WHETHER IN CONTRACT, TORT, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total aggregate liability arising out of or relating to the Site will not exceed one hundred U.S. dollars ($100). Nothing in these terms excludes liability that cannot lawfully be excluded. This section does not limit rights or remedies under a separate signed services agreement, which has its own terms.

11. Indemnification

You agree to indemnify and hold harmless Build Automate Grow, LLC, and its members, officers, and agents, from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising from your misuse of the Site or your breach of these terms.

12. Privacy

Our handling of information is described in our Privacy Policy, which forms part of these terms.

13. Governing law and venue

These terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws rules. You agree that the state and federal courts serving Platte County, Wyoming have exclusive jurisdiction over any dispute arising from these terms or the Site, and you consent to personal jurisdiction there.

14. General

If any provision of these terms is found unenforceable, the remainder stays in effect. Our failure to enforce a provision is not a waiver of it. These terms, together with the Privacy Policy and any applicable signed services agreement, are the entire agreement between us regarding the Site. You may not assign these terms; we may assign them in connection with a transfer of our business.
